Brainds.ai Terms & Conditions

Effective December 1, 2023

• Scope of Service:
  Brainds.ai provides Users with a first draft and up to two rounds of revisions of the requested content. After these revisions, the content will be handed over, and any further adjustments are the User’s responsibility. For a more detailed description of the process, please see How it Works
• Turnaround Time:
  Our commitment is to deliver the primary content within 48 hours and up to 2 additional rounds of edits. Users are given 90 days to reply with revisions.
• Pricing :
  All pricing is USD
• Content Ownership:
  Once the final content is handed over to the User, the User obtains full ownership. Brainds.ai retains no rights to the content and will not use it for any other purposes.
• No Misuse of Third-party Rights:
  Users must ensure that the content they provide to Brainds.ai or use in tandem with Brainds.ai’s services does not infringe on the proprietary or copyrighted information of a third party.
• Confidentiality:
  Brainds.ai is committed to the privacy and protection of User data. We do not share data or content with third parties. We honor and abide by data privacy laws in the United States, Canada, and Europe.
• No Political or Harmful Use:
  Users shall not use Brainds.ai’s services or resulting content for political purposes, political fundraising, gambling, or to incite hate, discrimination, antisemitism, or harm to minors, or any illegal activity.
• User’s Legal Responsibility:
  The User is wholly responsible for any legal or regulatory review or implications arising from the content they distribute. This includes any content initially created by Brainds.ai but later edited by the user.
• Indemnification:
  The User agrees to indemnify, defend, and hold harmless Brainds.ai from any claims, liabilities, penalties, or damages arising out of their use or distribution of the content.

Regulatory compliance: Should the User be a publicly traded company and subject to the laws and regulations of any securities regulatory, the User is responsible for ensuring that any content produced by Brainds.ai and delivered by Brainds.ai is in compliance with the securities regulations in the jurisdiction in which the User’s company is registered.

• Limitation of Liability: Brainds.ai shall not be held responsible for any consequences or liabilities arising from the User’s application of the content, including any legal or compliance issues.

Jurisdiction: All disputes or legal matters will be governed by the laws of British Columbia, Canada. Brainds.ai retains the right to select judicial or arbitration to resolve  any dispute.
